One of the sources of troubles and troubles accompanying foreigners temporarily residing in Ukraine (on the basis of a residence permit, visa, visa-free regime) is the violation by these persons of the terms of stay in Ukraine. Various reasons and obstacles stand in the way of the correct calculation of the duration of a foreigner's stay in Ukraine and their timely extension. A considerable number of foreign citizens can be convicted of violating the terms of their stay in Ukraine.
Despite a number of gaps, as well as rather peculiar requirements and rules in the legislation of Ukraine, there is still a certain procedure for extending the terms of stay of foreigners in Ukraine. This procedure concerns both the grounds for extension and the extension procedure itself, that is, the submission of documents to the relevant authorities.
Grounds for extending the period of stay on the territory of Ukraine. The procedure for submitting documents
The grounds for extending the stay on the territory of Ukraine may be: treatment, pregnancy or childbirth, caring for a sick family member, inheritance registration, applying for an immigration permit or acquiring citizenship of Ukraine, etc. Accordingly, each of the grounds must be properly confirmed.
Regarding the procedure for submitting documents to the migration service:
Not earlier than ten and not later than three working days to submit to the migration service an application for extension of the period of stay in Ukraine and the list of documents established by the legislation of Ukraine. The decision of the migration service to extend the period of stay on the territory of Ukraine made on the basis of the submitted documents will allow the foreigner to stay for a certain period (specified in the decision on the extension of the period) in Ukraine.
Force majeure
To leave the host country at the end of the period of stay is a mandatory requirement.
What should I do if, for some reason, a foreigner could not leave the country on time before the expiration of his stay in Ukraine and did not submit an appropriate application for an extension of his stay in Ukraine? Did not have time to apply for a residence permit, could not leave on time for health reasons, etc.
1. Submit to the migration service an application for extension of the period of stay in Ukraine and the list of documents established by the legislation of Ukraine. The decision of the migration service to extend the period of stay on the territory of Ukraine made on the basis of the submitted documents will allow the foreigner to stay in Ukraine for additional time.
Advantages of the option: if the application is satisfied, the foreigner has the opportunity to stay in Ukraine for a certain period of time. During this time, you can submit documents for legalization on the territory of Ukraine.
Disadvantages of the option: no guarantees of satisfaction of your application by the migration service.
2. Pay a fine for illegal stay in Ukraine and leave Ukraine. Re-entry is possible after a certain period of time, depending on the procedure for crossing the border established by the country of citizenship of the foreigner and the country of entry.
Advantages of the option:a foreigner has the opportunity to enter Ukraine without any problems after a while, and, if necessary, to be legalized here in accordance with the established procedure.
Disadvantages of the option: the need to leave Ukraine for a certain period (up to 90 days).
Both the first and second options of action for violated terms of stay on the territory of Ukraine, for obvious reasons, are not the most convenient for foreigners. The first option is due to the lack of guarantees, the second is the presence of certain inconveniences associated with leaving Ukraine. Often both options cause confusion and indignation on the part of foreigners, accompanied by the question "Are there simpler options?".
There is a simpler option: exclusively for persons who have not violated the terms of stay on the territory of Ukraine and promptly applied for their extension.
In this regard, we warn that it is much more difficult to extend the period of stay in Ukraine after the fact than with a timely application to the migration service with a corresponding application. In addition, there are no guarantees of satisfaction of the application submitted by a foreigner for an extension of the term with the terms of stay in Ukraine already violated.
We also draw attention to the fact that the control by certain state bodies of Ukraine over the stay of foreigners in Ukraine has recently intensified. In this regard, we ask you to treat the terms of stay of foreigners on the territory of Ukraine with greater responsibility and not to underestimate the legislation of Ukraine in this area in order to avoid unpleasant moments in the future.
